These terms of use apply to anyone accessing the website. By using the website, you confirm that you accept these terms and will comply with them. This page may be amended, and should visited from time to time to note any changes.

We will endeavour to maintain continuous service; however we cannot guarantee that our website will always be available without interruption.

Site Content

This is updated on a daily basis, but we do not guarantee that all information is up-to-date, or free from errors or omissions. We try to maintain the highest standards of customer service, and our success is dependent on our reputation. However, our website provides general information only. Customers are encouraged to obtain as much information as they feel is necessary before making a purchase. If you have any doubts you should obtain specialist advice before taking, or refraining from actions based on the content of our website.

Intellectual Property

We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it. Those works are protected by worldwide copyright laws and treaties.

Fleaglass.com website pages may only be downloaded, printed or recorded in any form, for personal non-business use. Copies of any materials printed off or downloaded in any way, must not be altered in any way.

Permission must be sought for any other use.

Limitation of Liability

We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with use of, or inability to use, our site or use of or reliance on any content displayed on our site.

We only allow dealers to use the website if, to the best of our knowledge, they have a good reputation and a good record of customer service. However, buyers and sellers should use their own judgement and perform their own due diligence on all transactions. All transactions occur between a visitor/buyer and the Fleaglass dealer.

We will not take part in any transaction or negotiation and we accept no liability for such transactions.

We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any content on it, or on any website linked to it.

We assume no responsibility for the content of websites linked on our site. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them.

These terms and conditions supersede any previous relevant agreements.

Terms and Conditions for Fleaglass sellers

Before you can register as a Dealer and access the services offered by Fleaglass Limited on our site(s) you must read and accept all the conditions and other policies set out below, as amended from time to time. This agreement is immediately effective for all current dealers and upon acceptance by new dealers. No one can use any of the dealer services on Fleaglass.com until they have confirmed they have read and accept these terms and conditions. Any disputes or claims arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) are governed by and construed in accordance with the law of England.

Meaning of Terms

Dealer: Dealer shall mean any party who opens a dealer account on the site.
Intellectual Property Rights: all intellectual property rights wherever in the world arising, whether registered or unregistered (and including any application), including copyright, confidential information, business names and domain names, trade marks, trade names, patents, design rights, database rights and all rights in the nature of unfair competition rights or rights to sue for passing off.
Services: the design and hosting of the site and all other services we provide to dealers by Fleaglass Ltd
Website, Site: our websites www.fleaglass.com and any other websites run by the company for this business.
Data Protection: 1. In this clause, Personal Data has the meaning given in the Data Protection Act 1998. 2. We warrant that, to the extent we hold any Personal Data on behalf of the Dealer, we shall: (a) only act on instruction from the Dealer; (b) store the Personal Data securely.

General Terms and Conditions

Our Authority. We have sole authority and discretion to operate and maintain the site. As such we reserve the right to remove any listing or part of any listing from our site at any time for any reason without notice to the dealer. We are under no obligation to remove or change any listing or part of any listing at any dealer’s request. Any such requests shall be resolved at our sole discretion. We reserve the right to cancel any dealer’s membership of Fleaglass. In this case we will inform the dealer prior to their removal and will refund the most recent monthly payment received.

Dealer Representations and Covenants. By using any of our services you, the dealer, will agree to abide by the following conditions and instructions:

You are not a minor under any applicable law and you have the authority to sign legal contracts.
The information you have provided us during the registration process and thereafter, including all information relating to your items for sale on the site is, to the best of your knowledge, complete, truthful and accurate. You responsible for the accuracy and completeness of the descriptions and all information given regarding items they sell on the site.
You have legal ownership of, or rights (including all intellectual property rights) to offer the items in your listing.
You will deal with us and buyers in good faith.
You will honour the terms of any sale.
You will refrain from any unruly, disruptive, unprofessional or other offensive conduct while using our site, communicating with Fleaglass.com personnel or any other member, buyer or seller on or through the site.
You will not harass or interfere with the privacy of any buyer, or post false, inaccurate, misleading, defamatory, or libellous content about any seller, buyer or the website.
You will not in any way utilize, copy, modify, distribute, or harvest content, including photographs and descriptions, from the site for use elsewhere, without obtaining advance permission.
Violate any laws, third party rights, or any of our policies posted on the site.
All transactions are to occur between a user of the Site (Customer) and the Dealer. We will not take part in any transactions or negotiations. The only exception is we may choose to mediate in any dispute if requested to do so by a site user.
You will not seek to include links to rival networks or our competitors. Links to a Dealer’s own domain name are only allowed with our permission.
We may, at our sole discretion, with immediate effect and without notice, terminate your agreement, restrict or terminate your access to the site, upon your breach of any of the above representations and covenants or the requirements given below.

Fees

By accessing and using the services available on Fleaglass.com you agree to pay the fees posted on our site. We reserve the right to suspend or remove listings from the Site in the event the Dealer fails to pay any amount owed to us.

Fleaglass.com Listing Requirements

These form part of the terms and conditions. We will also, as far as is practicable provide resources to assist dealers to achieve and maintain professional standards in their listings. To provide fleaglass.com customers with the highest quality of products we require all dealers to meet the following requirements generally and in every listing:

New or reproduction items are forbidden, with the exception of books.
While there is no maximum listing limit, you will endeavour not to dominate the main listings page – roughly 2/3 listings per day is optimal; daily listings should not exceed 5.
You must be registered on the site with your full name(s), and address(es).
You agree to only list items which are in your possession at that date. You agree to keep the listing up to date (i.e. mark sold items as sold using the dealer’s dashboard).
You must list at least 10 items in your first month then keep your unsold stock at or above 10 items at all times. There is no maximum limit for listings.
You must show your methods of payments accepted. These must include at least one method allowing international buyers to purchase.
Each item listed must have a full text description, at least one large image of the item in the listing.
Images must be of a standard suitable for a professional commercial website (see guidance).
All listings must display the correct price in the correct currency (except those listed as ‘Price On Application’, ‘POA’, ‘Price on Request’, ‘POR’ etc.)
Once an item is sold the price must be removed and a sold sticker must be applied. Sold items are to be displayed for a maximum of 90 days only. Any items found to be exceeding that will be removed by Fleaglass.
Items that cannot be legally sold or traded cannot be listed and if listed will be removed by us. A warning note should be added if sale to specific countries is legally restricted.
We reserve the right to decide to remove any listing at our discretion.
Each category may have its own listing criteria. Items listed must also meet those criteria. We reserve the right at any time to refuse or remove any items submitted by a Dealer to the site if we feel they do not fit in with the rest of the stock in that category.
We will not allow Dealers to delete and then relist the same items again as new stock.
Minimum value of any one listed item can be no lower than GBP 50.00 or equivalent
All defects, repairs and restoration that affect value should be noted.
All images must be clear and in focus.

Re-use of images and text

In the course of advertising Fleaglass.com we may use images taken by dealers on the site. Likewise, for purposes of SEO (Search Engine Optimization), we may use text that you have created in order to generate content for the website. By agreeing to these Terms & Conditions you are agreeing to the re-use of your images and text for the purposes of promoting Fleaglass.com and SEO on the site.

Ban on selling or advertising ivory

Since 6 June 2022 it has been illegal to deal in items containing or made of elephant ivory under the Ivory Act 2018 unless they are registered as exempt or certified as exempt.

Registering old instruments with less than 10% ivory is a simple process and costs £20. See https://www.gov.uk/guidance/dealing-in-items-containing-ivory-or-made-of-ivory

Fleaglass and its dealers comply without exception with this law, and items containing ivory will not be permitted on the site without registration documents explicitly mentioned in the listing.

We reserve the right to make reasonable changes to these Terms at any time and will notify you of any changes 14 days prior to making them.
